How Does Essure Work?

Essure is a device that permanently sterilizes a woman by blocking off the fallopian tubes.

Essure consists of a plastic cylinder surrounded by two metal coils (one made of nickel-titanium and another of stainless-steel) coated in polyethylene terephthalate (PET) fibers. After several months, PET fibers cause inflammation and scar-tissue growth that prevents fertilization of egg and sperm.

Women Challenge “Fraudulent” Essure Approval

Conceptus Inc., now a subsidiary of Bayer, received Pre-Market Approval (PMA) for Essure in 2002. This rigorous approval protects manufacturers from lawsuits so long as they follow strict rules during pre-market safety studies.

Unfortunately, thousands of women have been injured by Essure. In 2014, the first lawsuit to challenge the validity of Essure’s PMA was filed in Pennsylvania. The plaintiff accuses Conceptus of fraud by concealing adverse events from the FDA (Case No. 2:15-cv-00384).

FDA Investigates Safety of Essure

The FDA cited Conceptus after reviewing an Excel spreadsheet listing 16,047 entries for complaints that were not properly reported. Plaintiffs also claim Conceptus had 168 reports of organ perforations but only reported 22 events to the FDA. Some women have also accused Conceptus of falsifying medical records during safety studies of Essure.

Study Links Essure and 10X Risk of Follow-Up Surgery

By September 2015, the FDA had received over 5,000 adverse events involving Essure and launched a safety investigation. The British Medical Journal also published a study showing that follow-up surgery was 10X more likely for women who got Essure instead of a traditional tubal ligation.

About Class Actions

Class action lawsuits are beneficial for large groups of people with relatively minor injuries. A lawsuit is filed by a representative on behalf of the entire class and lawyers use that person’s case to fight for compensation on behalf of the group. If compensation is awarded, lawyers take a cut and the rest is divided among plaintiffs.

Why Our Law Firm is Filing Individual Lawsuits as Opposed to a Class Action

There can be many disadvantages to class actions for people with serious injuries — especially when lawyers accept a “low-ball” settlement and take a huge cut of the payout. Instead of a class action, our attorneys file individual lawsuits and fight to maximize compensation for each of our clients.

Thousands of women have been injured by Essure and it is possible that many lawsuits will be filed. If you were injured by Essure, our attorneys may be able to help you join this litigation and seek compensation for your medical expenses, pain and suffering, lost income, permanent disability, and more.
